Terms & Conditions of Service

These Terms & Conditions apply to services performed by Astorga Stain & Wash LLC (“Astorga Stain & Wash,” “Company,” “we,” or “us”). By approving an estimate, paying a deposit, scheduling work, or otherwise authorizing us to begin services, the customer (“Customer”) acknowledges and agrees to these Terms & Conditions.

1. Estimates & Scope of Work

All estimates are based on the visible condition of the property and the information available at the time the estimate is prepared.

The approved estimate describes the specific services included in the project. Any work not specifically listed on the estimate is considered outside the original scope of work and may require an additional charge.

If unforeseen conditions are discovered after work begins that materially affect the scope, materials, labor, or method required to complete the project, Astorga Stain & Wash will communicate those conditions to the Customer before performing significant additional work whenever reasonably possible.

2. Customer Authorization

By accepting an estimate or authorizing service, the Customer confirms that they:

  • Are the property owner or have authorization from the property owner to approve the work;

  • Have reviewed and approved the scope of work;

  • Have disclosed any known property conditions that may affect the safe completion of the work; and

  • Authorize Astorga Stain & Wash to enter the areas of the property reasonably necessary to complete the contracted services.

3. Customer Preparation

Unless otherwise agreed, the Customer is responsible for preparing the work area prior to our arrival.

This includes, when applicable:

  • Closing and securing all windows and doors;

  • Removing fragile, valuable, or water-sensitive items from the work area;

  • Moving outdoor furniture, decorations, cushions, rugs, toys, grills, and similar items when reasonably possible;

  • Unlocking gates and providing access to areas included in the project;

  • Keeping children and pets away from active work areas;

  • Identifying damaged, loose, leaking, or otherwise compromised areas of the property;

  • Identifying known electrical issues, water intrusion concerns, irrigation systems, landscape features, or other sensitive items;

  • Identifying newly planted, recently transplanted, stressed, unhealthy, rare, ornamental, or high-value plants;

  • Moving potted plants and movable landscaping away from the work area whenever reasonably possible; and

  • Ensuring vehicles or other property that may interfere with the work are moved when requested.

Astorga Stain & Wash is not responsible for delays or additional labor caused by areas that were not reasonably prepared or accessible.

4. Water & Electrical Access

The Customer agrees to provide reasonable access to an operational exterior water source when required for the contracted service.

If electrical access is required for a specific project, the Customer agrees to provide access to a safe and functioning electrical outlet unless otherwise arranged.

5. Pressure Washing & Soft Washing

Astorga Stain & Wash selects cleaning methods based on the surface being treated. Depending on the project, this may include pressure washing, soft washing, surface cleaning equipment, detergents, sodium hypochlorite-based cleaning solutions, surfactants, degreasers, or other professional cleaning products.

The Customer acknowledges that cleaning may reveal conditions that were previously hidden by dirt, algae, mildew, oxidation, staining, or other buildup.

These may include:

  • Faded or oxidized paint or siding;

  • Existing scratches, cracks, chips, or discoloration;

  • Loose paint or coatings;

  • Damaged caulking or seals;

  • Deteriorated wood;

  • Rust stains;

  • Concrete imperfections;

  • Mortar deterioration;

  • Previously repaired areas;

  • Organic or permanent staining; and

  • Differences in color caused by weathering or previous exposure.

The appearance of these conditions following cleaning does not, by itself, establish that the condition was caused by the cleaning process.

6. Oxidation & Existing Surface Conditions

Certain exterior surfaces, particularly vinyl siding, painted metal, gutters, shutters, and older painted surfaces, may develop oxidation over time.

Standard exterior washing is intended to remove organic growth and surface contaminants and does not necessarily remove oxidation.

Cleaning may make pre-existing oxidation more noticeable because surrounding dirt and organic material have been removed.

Oxidation removal, restoration, paint correction, or specialty stain removal is not included unless specifically stated in the approved estimate.

7. Water Intrusion

Pressure and soft washing involve the application of water to exterior surfaces.

The Customer is responsible for notifying Astorga Stain & Wash of any known leaks, failed seals, improperly installed windows or doors, damaged siding, openings, deteriorated caulking, or other conditions that may permit water intrusion.

Astorga Stain & Wash will use reasonable professional care when cleaning around windows, doors, vents, electrical fixtures, and other openings. However, the Company cannot guarantee against water intrusion caused by pre-existing construction defects, failed seals, improper installation, deterioration, or other conditions outside of our control.

8. Landscaping, Plants & Chemical Exposure

Exterior cleaning necessarily involves the use of water and may involve detergents, sodium hypochlorite-based cleaning solutions, surfactants, degreasers, stain removers, wood cleaners, brighteners, and other professional exterior-cleaning products.

The Customer acknowledges and accepts that chemical exposure, overspray, runoff, mist, water saturation, or incidental contact with landscaping is an inherent risk of exterior cleaning and restoration services, particularly when vegetation is located directly against or immediately adjacent to the surface being treated.

Astorga Stain & Wash will use reasonable industry-standard precautions intended to reduce exposure to landscaping. These precautions may include:

  • Pre-wetting vegetation and surrounding soil;

  • Rinsing vegetation during service;

  • Performing a post-service rinse;

  • Directing runoff away from landscaping when reasonably possible;

  • Diluting incidental chemical exposure with water;

  • Temporarily covering particularly sensitive vegetation when appropriate; and

  • Adjusting application methods around landscaped areas when reasonably practical.

These measures are intended to reduce risk but cannot eliminate it completely.

Customer Disclosure Responsibilities

Before service begins, the Customer is responsible for specifically identifying any:

  • Newly installed or transplanted vegetation;

  • Plants already experiencing stress, wilting, discoloration, disease, or insect activity;

  • Rare, specialty, ornamental, or unusually valuable plants;

  • Vegetable gardens, herb gardens, fruit-bearing plants, or edible landscaping;

  • Plants known to be particularly sensitive to sodium hypochlorite, detergents, excessive water, or environmental changes;

  • Landscaping with pre-existing irrigation or drainage issues; and

  • Areas where chemicals or runoff cannot safely drain.

Failure to identify sensitive landscaping before work begins constitutes acceptance of the normal risks associated with performing exterior cleaning around that landscaping.

Pre-Existing & Subsequent Plant Conditions

Plants and landscaping are living organisms whose condition can change rapidly and may be affected by factors entirely unrelated to Astorga Stain & Wash's services.

Such factors include, but are not limited to:

  • Heat;

  • Cold;

  • Drought;

  • Excessive watering;

  • Insufficient watering;

  • Soil conditions;

  • Poor drainage;

  • Root damage;

  • Transplant shock;

  • Fertilizers;

  • Herbicides or pesticides;

  • Disease;

  • Fungal conditions;

  • Insects;

  • Irrigation;

  • Sun exposure;

  • Environmental stress;

  • Previous chemical applications;

  • Landscaping treatments performed by others; and

  • Normal plant decline.

Accordingly, a change in the appearance, coloration, health, or condition of vegetation following service does not, by itself, establish that Astorga Stain & Wash caused the condition.

The Customer acknowledges that Astorga Stain & Wash cannot evaluate or guarantee the health of individual plants before or after service and is not acting as a horticulturist, arborist, landscaper, or plant-health professional.

Assumption of Landscaping Risk

By authorizing exterior cleaning around landscaping, the Customer knowingly accepts the ordinary and inherent risks associated with performing chemical exterior-cleaning services in proximity to vegetation.

Astorga Stain & Wash is not responsible for plant stress, discoloration, leaf spotting, leaf drop, wilting, temporary appearance changes, or plant decline arising from:

  • Normal and incidental exposure associated with the contracted service;

  • Pre-existing plant or soil conditions;

  • Environmental conditions;

  • Improper or excessive watering before or after service;

  • Failure to disclose sensitive landscaping;

  • Customer-applied chemicals or treatments;

  • Irrigation systems;

  • Runoff conditions outside the Company's reasonable control; or

  • Other causes that cannot reasonably be attributed to Astorga Stain & Wash's failure to exercise reasonable care.

Nothing in this section is intended to exclude liability that cannot legally be waived under applicable law.

Post-Service Landscaping Care

After service, the Customer assumes responsibility for the ongoing watering, maintenance, monitoring, and care of all landscaping.

If the Customer believes landscaping may have been affected by the service, the Customer must notify Astorga Stain & Wash promptly and allow the Company a reasonable opportunity to inspect the affected area before the vegetation is removed, replaced, treated, or materially altered.

Removal or replacement of landscaping before Astorga Stain & Wash has been provided a reasonable opportunity to inspect it may substantially limit the Company's ability to evaluate any claim.

9. Concrete Cleaning

Concrete is a porous material and may contain stains or discoloration that cannot be completely removed through standard pressure washing.

Cleaning may reveal:

  • Oil stains;

  • Rust;

  • Fertilizer stains;

  • Irrigation stains;

  • Tire marks;

  • Mineral deposits;

  • Organic staining;

  • Surface inconsistencies;

  • Previous pressure-washing marks;

  • Concrete curing variations; or

  • Damage or discoloration already present within the concrete.

Astorga Stain & Wash does not guarantee complete removal of permanent or deeply embedded staining unless specifically stated in writing.

Recently poured concrete must be disclosed to us before service.

10. Wood Cleaning & Restoration

Wood is a natural material and may respond differently to cleaning based on age, species, moisture content, previous coatings, sun exposure, installation, and overall condition.

Cleaning may expose:

  • Previous stain inconsistencies;

  • Mill marks;

  • Weathering;

  • Splintering;

  • Nail or fastener stains;

  • Wood rot;

  • Previous repairs;

  • Differences in board coloration; or

  • Other naturally occurring variations.

Some amount of wood grain raising or minor surface texture change may occur as part of the cleaning and preparation process.

11. Staining Services

Wood staining results are influenced by the age, species, porosity, previous coatings, moisture content, weather exposure, and condition of the wood.

Color samples, manufacturer images, brochures, photographs, and digital representations are intended as guides only. Final color may vary once stain is applied to the Customer's specific wood.

Previously stained surfaces may also absorb new stain differently than new or untreated wood.

Astorga Stain & Wash does not guarantee that every board will have an identical shade or appearance.

Natural variations in wood grain, color, knots, age, repair areas, previous exposure, absorption, and weathering are not considered workmanship defects.

12. Stain Color Approval

The Customer is responsible for selecting and approving the stain color prior to application.

Once the Customer has approved a stain color and application has begun, changes requested by the Customer may result in additional material, labor, cleaning, stripping, or reapplication charges.

Custom-ordered or purchased stain and materials are non-refundable once ordered.

13. Stain & Product Warranty

Astorga Stain & Wash does not provide a separate warranty, guarantee, or stated service-life warranty on staining services or stain performance.

Any warranty applicable to stain, paint, sealer, cleaner, or other materials used on a project is provided solely by the product manufacturer and is subject to that manufacturer's warranty terms, exclusions, eligibility requirements, and claims process.

Astorga Stain & Wash does not control and cannot guarantee:

  • Manufacturer warranty approval;

  • Length of manufacturer warranty coverage;

  • Product longevity;

  • Color retention;

  • Normal fading;

  • Weathering;

  • Wear;

  • Peeling or coating failure resulting from conditions outside the Company's control;

  • Wood movement;

  • Moisture intrusion;

  • Sap or tannin bleed;

  • Mold, mildew, or organic growth;

  • Irrigation exposure;

  • Standing water; or

  • Changes in the substrate after application.

Astorga Stain & Wash does not extend, modify, replace, or independently guarantee any manufacturer warranty.

If a product appears to have failed due to a manufacturing defect, Astorga Stain & Wash may, at its discretion, assist the Customer with locating manufacturer warranty information or documentation. Any claim remains subject to the manufacturer's determination.

Nothing in this section eliminates Astorga Stain & Wash's responsibility to perform the originally contracted application services using reasonable professional care.

14. Overspray & Adjacent Areas

Astorga Stain & Wash takes reasonable precautions to control staining and cleaning products.

The Customer must disclose any nearby property, vehicles, furniture, decorations, landscaping, or other items that require special protection.

Customers should move vehicles and valuable personal property away from active staining and washing areas when requested.

15. Weather & Scheduling

Exterior washing and staining are weather-dependent services.

Rain, excessive moisture, extreme temperatures, high winds, storms, unsafe working conditions, material requirements, or other environmental conditions may require us to postpone or reschedule service.

Weather-related scheduling changes are not considered a breach of the service agreement.

Astorga Stain & Wash will make reasonable efforts to reschedule affected projects as promptly as conditions allow.

16. Project Timing

Any completion dates or estimated project durations provided by Astorga Stain & Wash are estimates unless specifically guaranteed in writing.

Project timing may be affected by weather, drying conditions, material availability, property conditions, additional work requested by the Customer, equipment issues, or circumstances outside our reasonable control.

17. Deposits

Certain projects may require a deposit before materials are ordered or a project is added to the schedule.

The required deposit amount, if applicable, will be shown on the estimate or invoice.

Once materials have been ordered for a project, all deposits become non-refundable.

The Customer acknowledges that deposits may be used to purchase project-specific materials and reserve labor and scheduling availability.

If the Customer cancels after materials have been ordered, the deposit will not be refunded, regardless of whether those materials have been delivered or applied.

If the cost of specially ordered or non-returnable materials exceeds the deposit amount, the Customer remains responsible for any additional material costs actually incurred for the project.

18. Changes & Additional Work

Any request to modify the original scope of work may result in additional charges.

Examples include:

  • Additional surfaces;

  • Additional cleaning;

  • Specialty stain removal;

  • Additional coats of stain or paint;

  • Color changes after materials have been purchased;

  • Repairs or preparation not included in the original estimate;

  • Moving substantial amounts of customer property; or

  • Work resulting from conditions that could not reasonably be identified during the estimate.

Whenever reasonably possible, additional charges will be communicated before the additional work is performed.

19. Cancellation & Rescheduling

Customers must provide at least 48 hours' notice to cancel or reschedule a scheduled service.

Cancellation or rescheduling requests received at least 48 hours before the scheduled service may be accommodated without a cancellation charge; however, any deposit that has already become non-refundable because materials were ordered remains non-refundable.

Cancellations or customer-requested rescheduling occurring less than 48 hours before the scheduled service may be subject to a cancellation or rescheduling charge reflecting reserved labor, scheduling commitments, mobilization expenses, or other costs reasonably incurred by Astorga Stain & Wash.

Failure to provide access to the property, water access, required approvals, or other conditions necessary to perform the work at the scheduled time may be treated as a cancellation with less than 48 hours' notice.

Weather-related postponements initiated by Astorga Stain & Wash are not considered Customer cancellations and will not result in a cancellation fee.

Repeated cancellations or rescheduling may require a new deposit before another project date is reserved.

20. Payment

Unless otherwise stated in writing, payment is due upon completion of the contracted work.

Accepted payment methods may include cash, check, electronic transfer, Zelle, and credit/debit card.

Card transactions may be subject to a 3% processing fee, where permitted by applicable law and disclosed to the Customer.

Any deposit previously paid will be credited toward the final project balance.

The Customer may not withhold payment for portions of the project that have been satisfactorily completed because of a concern involving a separate portion of the work.

21. Past-Due Balances

Balances not paid according to the agreed payment terms may be subject to reasonable collection efforts and any fees or remedies permitted by the agreement and applicable law.

The Customer will be responsible for reasonable costs of collection to the extent permitted by law.

22. Inspection of Completed Work

Customers are encouraged to inspect the completed work as soon as reasonably possible.

If the Customer believes there is an issue with workmanship or property damage caused by Astorga Stain & Wash, the Customer must notify us promptly and provide reasonable access to inspect the area.

The Customer agrees to provide Astorga Stain & Wash a reasonable opportunity to investigate and, when appropriate, correct a workmanship issue before hiring another contractor to alter or repair the affected area.

23. Property Damage Claims

Astorga Stain & Wash is responsible for damage directly caused by our failure to perform the contracted services with reasonable professional care.

We are not responsible for damage or failure resulting from:

  • Pre-existing conditions;

  • Improper installation;

  • Deteriorated materials;

  • Hidden defects;

  • Loose siding, trim, paint, mortar, or fixtures;

  • Failed seals or caulking;

  • Rot or structural deterioration;

  • Customer modifications;

  • Manufacturer defects;

  • Previously damaged surfaces;

  • Conditions that were not reasonably visible or disclosed before service; or

  • Inherent risks specifically disclosed and accepted elsewhere in these Terms & Conditions.

The mere fact that damage or a change in condition becomes visible during or following service does not, by itself, establish that Astorga Stain & Wash caused the condition.

Nothing in these Terms is intended to eliminate any rights or remedies that cannot legally be waived under applicable law.

24. Opportunity to Inspect & Cure

If a Customer reports a concern involving workmanship, landscaping, or alleged property damage, Astorga Stain & Wash must be provided a reasonable opportunity to inspect the alleged issue and determine whether corrective action is appropriate.

Except in an emergency requiring immediate action to prevent additional property damage, the Customer should not authorize another contractor, landscaper, plant professional, or other third party to alter, repair, remove, replace, or treat the disputed property before Astorga Stain & Wash has been given a reasonable opportunity to inspect it.

Failure to provide a reasonable opportunity for inspection may impair the Company's ability to evaluate or verify a claim.

25. No Guarantee of Like-New Appearance

Exterior cleaning and staining are restoration and maintenance services.

Astorga Stain & Wash does not guarantee that aged, damaged, weathered, stained, or previously coated surfaces will appear new after service.

Our obligation is to perform the contracted work using reasonable professional care and industry-appropriate methods.

26. Pets, Children & Occupants

For safety, pets, children, residents, guests, and other persons should remain clear of active work areas, equipment, hoses, chemicals, wet surfaces, freshly stained areas, and caution-taped areas until they are safe for normal use.

The Customer is responsible for supervising occupants and animals on the property.

27. Access to Property

The Customer authorizes Astorga Stain & Wash and its employees, contractors, and representatives to access areas of the property reasonably necessary to complete the contracted work.

If the Customer will not be present during service, the Customer is responsible for ensuring that necessary gates, water sources, and work areas are accessible.

28. Photographs

Astorga Stain & Wash may photograph or video work areas before, during, and after service for documentation, quality control, training, claim documentation, and business records.

Unless the Customer requests otherwise in writing before the project, non-identifying photographs of completed exterior work may also be used for portfolio, website, social media, or marketing purposes.

We will make reasonable efforts not to publish personally identifying information, house numbers, license plates, people, or other private information without permission.

29. Third-Party & Neighboring Property

The Customer is responsible for informing neighbors, tenants, HOA representatives, property managers, or other affected parties when access or temporary restrictions may be necessary.

The Customer must inform Astorga Stain & Wash if any portion of the requested work is located on property that the Customer does not own or control.

30. Force Majeure

Astorga Stain & Wash will not be responsible for delays or inability to perform caused by circumstances reasonably outside our control, including severe weather, natural disasters, government restrictions, utility outages, material shortages, illness, equipment failure, unsafe site conditions, or similar events.

31. Limitation of Liability

To the fullest extent permitted by applicable law, Astorga Stain & Wash's responsibility for a valid property damage or workmanship claim will be limited to the reasonable cost of repairing the portion of the property directly affected by our work or otherwise satisfying the Company's obligations under applicable law.

Astorga Stain & Wash will not be responsible for indirect, incidental, consequential, speculative, or loss-of-use damages to the extent such limitations are permitted by applicable law.

Nothing in this section is intended to exclude or limit liability that cannot legally be excluded or limited.

32. Entire Agreement

The approved estimate, invoice, these Terms & Conditions, manufacturer documentation, and any written project-specific terms or approved change orders collectively constitute the agreement between the Customer and Astorga Stain & Wash.

Project-specific written terms included on an estimate or change order will control if they conflict with these general Terms & Conditions.

33. Severability

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

34. Governing Law

These Terms & Conditions are governed by the laws of the State of South Carolina.

35. Acceptance

By electronically accepting an estimate, signing an agreement, paying a required deposit, or otherwise authorizing Astorga Stain & Wash to perform the work, the Customer confirms that they have had the opportunity to review and agree to these Terms & Conditions.
